| Announcement No.92， 2008 of Ministry of Commerce on Bringing Phosphate Ore into Management of Export Quota Admission |

To strengthen the management of phosphate ore export, regulate export order, protect source and environment, and to expedite the sustainable development of industries, in accordance with the related regulations in Law of the People’s Republic of China on Foreign Trade and Regulations of the People’s Republic of China on Cargo Import and Export, the related terms about management of phosphate ore export are announced as follows:
1.As from Jan 1 of 2009, management of phosphate ore (Customs llist No: 25101010, 25101090, 25102090 ) export quota shall be carried out. The total volume of phosphate ore export quota of 2009 shall be 1.5 million tons.
2.As from today, according to the requirements of this announcement, enterprises may submit materials to the local commercial departments of the provincial level for phosphate ore export quota.
3.In accordance with regulations in the appendix, the local commercial departments of the provincial level shall carry out preliminary examination on the materials admitted by enterprises, then admit materials of the qualified enterprises to the Ministry of Commerce, and to make a copy for China Chamber of Commerce of Metals Minerals & Chemicals Importers & Exporters. According to opinions of the local departments and the related commercial comities, Ministry of Commerce shall announce, after examination, the name list of qualified enterprises.
4.In accordance to Measures for Certificate Management of Cargo Export (Order No.28, 2004 of Ministry of Commerce), the qualified enterprises shall apply for export certificate with the local correspondent of Ministry of Commerce. The Customs shall handle clearance according to the export certificate.
5.Ministry of Commerce shall be responsible for explanation of this announcement.
